Elbert County is part of the Northern Judicial Circuit, located south of Hart County, on the South Carolina border.  While there are no interstate highways running through the county, there are a number of state highways and county roads that are patrolled by the Georgia State Patrol and by the Elbert County Sheriff's Department.  The county seat is Elberton.  Elberton Police Department patrols within the city limits of Elberton.

Traffic tickets and misdemeanors generally go to the Municipal Court of Elberton or the State Court of Elbert County, depending on where the offense occurred.  More serious charges go the Superior Court of Elbert County, Georgia.
