A particular form of burglary is the "smash and grab" burglary. Basically, this is the case where a person throws a brick through the storefront window and goes in and grabs whatever they can and runs.
Legally, there are some specific requirements.
The retail establishment must be one that sells goods or merchandise from a fixed location and includes restaurants. Â
In the course of making entry, the offender must do in excess of $500 in damages in order to qualify for this offense.
It is punishable by 2 to 20 years and a fine up to $100,000 or both. A second or subsequent conviction increases the incarceration range to 5 to 20 years.
