Georgia law provides for increased penalties for so-called home invasion burglaries.  These involving entering a structure where someone is present with the intent to commit a forcible felony or misdemeanor.  

The  degree of the forcible offense determines the degree of the offense.  A forcible felony gives rise to a first degree offense, while a forcible misdemeanor gives rise to a second degree offense.
