Aggravated Sexual Battery

Aggravated sexual battery is a very serious offense.

The statute provides that it is committed where a person intentionally penetrates with a foreign object the sexual organ or anus of another person without the consent of that person. Foreign object means any article or instrument other than the sexual organ of a person.

Case law decisions have broadly interpreted foreign object to include a finger. So, digital penetration without consent can result in prosecution for a felony that carries life in prison or 25 years in prison followed by life in prison.
