Toccoa Man Avoids DUI ConvictionMay 16, 2001 - Toccoa. Following a four hour trial today, a Toccoa man avoided a DUI conviction. The man had been charged with DUI, Fleeing and Attempting to Elude, Speeding and Open Container after a December 2000 police chase. The arresting officer testified to seeing the man emerge from the driver's side of a Ford Mustang following a two mile chase. The man and the front seat passenger testified that the man had been seated in the rear of the automobile and had jumped out of the car after another subject fled from the scene on foot. The officer denied seeing another subject but did admit that the man had run up to him saying that a man named "Rick" had been driving and had run off. The officer admitted that the front seat passenger who was sober also stated that a man named Rick had been driving. As the judge struggled with the decision as to the outcome of the trial, the prosecution agreed to allow the man to plead to a reckless driving charge. The court had earlier ruled inadmissible a BAC test which showed a blood alcohol content of 0.18. If the man had been convicted, the DUI would have been his second in five years and his fourth lifetime. |
